Family Provision Claims
(contesting an unfair Will)
A Family Provision Claim is made under the Succession Act 2006 (NSW). Under the legislation, an eligible person may make a Family Provision Claim and contest the distribution of assets under a Will. The Court will determine whether adequate provision has been made for the eligible person, but they may challenge the Will if they think it is unfair. If you think that your treatment under a Will has been unfair, we are able to make such a claim on your behalf.
Similarly, if you are an Executor or a beneficiary under a Will, that Will may be challenged or contested by someone else who believes it is an unfair Will. If you believe that a Family Provision Claim made by another person on the Estate is unfair or unwarranted, we can assist you in defending such a claim.
